Karnataka also claims that Tamil Nadu constructed a watchtower and a hanging bridge near the waterfall, without informing Karnataka. Karnataka had reportedly recommended a joint survey of the area in August 2003 and September 2005, but there was no response from Tamil Nadu. Meanwhile, Tamil Nadu maintains that a survey would be unnecessary as the land undoubtedly belongs to them.

Interestingly, in spite of fighting over the Hogenakkal for nearly 30 years, neither state has approached the court to settle the matter, but prefer dashing off letters to each other. Lawyers, currently handling border issues and water disputes for Karnataka in the Supreme Court, suggest that the two governments should try to resolve the issue amicably.

Karnataka cannot afford any more disputes in the Supreme Court as it is already notorious for picking up fights with its neighbours.
