HC stops Netware Infosys too from digging trenches

The Delhi high court on Monday restrained Reliance-owned Netware Infosys Pvt Ltd from digging trenches and pits for laying cables in the capital on MTNL's allegation that the "negligent" digging by the private company has damaged telephone cables paralysing the service.

"The defendants (Netware Infosys), its agents and contractors are restrained from digging trenches and pits for laying cables in any of the MCD (municipal corporation of Delhi) and NDMC (New Delhi municipal corporation) area," Justice Vijender Jain said directing the private company to file its reply by July 6.

Appearing for MTNL, additional solicitor general Mukul Rohtagi and advocate R K Sanghi alleged that Netware Infosys was carrying on its cable laying work by flouting all the guidelines under which it had to work, and had caused irreparable damage to the Nigam.

Rohtagi said MTNL's cable network had been damaged at several places resulting in paralysing of its services including the VIP areas.

Stating that the private company has been digging pits througout the city at a high speed, Rohtagi maintained it was carrying out the operation in "violation of the provisions of Indian Telegraphic Act without giving prior notice to MTNL".

MTNL also accused Network Infosys of not using ground positioning radar system while digging the trenches.

GPRS is an effective equipment used for locating the underground cables before digging the place, MTNL counsel told the court.
