According to the CBI charge-sheet in the encounter case, which leaves out some important questions, five Gujarat cops fired 70 rounds on the four persons they branded as terrorists. Sheela Bhatt presents a summary of the CBI charge-sheet of the "extra-judicial" killings that are haunting the Gujarat government.
The charge-sheet in the encounter deaths of Ishrat Jahan and three other was filed on July 3 in the Ahmedabad high court by the Central bureau of Investigation. As reported on rediff.com, the charge-sheet has avoided a few important issues but it gives a chilling account of the chronology of the crime committed by seven Gujarat policemen and a team of Intelligence Bureau officers.
One will have to wait till the CBI files a supplementary charge-sheet to know if the IB's senior officer Rajendra Kumar is nailed for his alleged role in the encounter. There is extraordinary, behind-the-scenes, pressure being applied to not take on Rajendra Kumar because ultimately, the argument goes, it will be IB the institution that will be rocked.
Possibly the CBI is waiting for him to retire. A senior police officer in Gujarat said that a careful reading of the charge-sheet, the summary of which is given below, suggests that without IB becoming an ‘equal culprit” as much as the Gujarat policemen, the legal case will ultimately get weakened.
The charge-sheet filed by the CBI clearly says, ‘That the investigation conducted so far disclosed that the above said fake encounter was a result of a joint operation of the Gujarat police and SIB, Ahmedabad. In this operation the overt acts committed by the accused Gujarat police officers have been established by the evidence on record. However, further investigation is in progress against the SIB officers, namely Rajinder Kumar, M K Sinha, Rajeev Wankhede and T Mittal and others.’
In short, it is argued that in this sensational case of encounter deaths, the ball is in the CBI's court. IB chief Asif Ibrahim has written to the home ministry against the "witch-hunt" by the CBI, reports a newspaper, but a senior CBI officer told rediff.com, "We have kept Ibrahim informed at all stages. Ibrahim has seen the evidence against IB officer Rajendra Kumar."
Here is a summary of the Ishrat Jahan encounter case as given in the charge-sheet:
‘As per the orders passed by the Hon’ble High Court of Gujarat vide its judgment dated 01.12.2011 in criminal miscellaneous application No. 15981 of 2010, in criminal miscellaneous application No. 9832 of 2010 with special criminal application No.1850 of 2009, wherein direction was given to the chairman of the SIT to file a fresh FIR with the CBI in consequence of the unanimous conclusion of the SIT that the purported police encounter, as mentioned in the FIR of Ahmedabad City DCB PS I CR No. 8/2004, was not genuine and accordingly on the basis of the written complaint of R R Verma, chairman of the last SIT formed under orders of the high court of Gujarat, Central Bureau of Investigation, special crime branch, Mumbai registered an FIR vide RC BS1/S/2011/0005 on 16.12.2011, and took up the investigation.

‘Thereafter an application on 7.11.06 was filed by DCB PS before the spl judge for POTA cases, Ahmedabad, and it was prayed to accept ‘A-Summary’ with respect to the absconding accused.
‘That various petitions in the hon’ble high court of Gujarat and in the hon’ble Supreme Court of India were filed. It implies that the right of private defence for causing the death of four deceased persons does not legally accrue to the accused Gujarat police officers.
‘Therefore, those officers named to have given effect to the incident as narrated in the FIR of Ahmedabad City DCB PS I CR No. 8/ 2004 and found to be responsible to have caused the death of four deceased persons, and those found to be culpable in further investigation in addition, have committed offences punishable under sections 302, 364, 368, 346, 120-B, 201, 203, 204, 217, 218 of the Indian Penal Code, and under sections 25(1)(e), 27 of the Arms Act.
