Woman gets HC rap over 'fatherhood' row

Admitting a writ petition filed by a man seeking to restrain his wife from getting her pregnancy terminated, the Lucknow Bench of the Allahabad High Court on Thursday issued a notice to her.

A Division Bench comprising Justices Jagdish Bhalla and M A Khan, however, rejected the petitioner's plea for issuing directions to the state and the Centre to instruct all hospitals within their limits to disallow termination of his wife's pregnancy.

The petitioner Rajiv Nandi has challenged certain provisions of the Medical Termination of Pregnancy Act, 1971, which empowers a woman to get her pregnancy terminated if she is not medically fit to deliver a baby.

The petitioner had urged the court to intervene and ensure, what he termed, his 'right to fatherhood'.

The petitioner pleaded that the consent of the father should also be taken before termination of pregnancy by the wife.
