Why keep Kumaraswamy out of land scam case: Plea

Seeking to drag matters further, another application has been filed before the Karnataka special sessions court seeking a direction to produce former chief minister and Janata Dal-Secular leader H D Kumaraswamy before it.

The application filed before the special sessions court, which is hearing two complaints filed against B S Yeddyurappa in connection with a land scam, states that unless Kumaraswamy is brought before the court, proceedings cannot continue.

The new application before the court states that the facts have been jumbled and that Chief Minister BS Yeddyurappa had allegedly de-notified only a small portion of the land at Rachenahalli in favour of his family members. However, strangely the name of the HD Kumaraswamy does not figure in the complaint, considering that a major portion of the land was de-notified by him.

The application, which has been filed under Section 319,

says that offences should not be made selectively and all that those involved in illegalities should be brought before the same forum and justice should be equal to all.

The court will hear this application on January 31 when it commences proceedings next.

On the same day, it will also hear an application filed by Yeddyurappa's son-in-law Suhan Kumar and also the case filed by advocates Sirajin Bhasha and K N Balakrishna,  who are seeking prosecution of the Karnataka chief minister in connection with the 15 charges pertaining to various land scams.

Meanwhile, the state Congress unit has decided to hold a rally in Bengaluru demanding the dismissal of the Yeddyurappa government.

The Congress says that the chief minister had no moral right to continue after the Governor had accorded sanction to prosecute him.
