SC stays K'tka HC judge's orders on Dinakaran

The Supreme Court of India has stayed four orders passed by Justice D V Syhlendra Kumar in which he had made remarks about the roaster system and also allocation of matters by both the Registrar Judicial and the Chief Justice of the Karnataka High Court.

A Division Bench of the Supreme Court, headed by Justice Deepak Verma, however observed the matter ought to be placed before the Chief Justice of India since it involved judicial discipline.

A huge controversy was created in the Karnataka High Court after Justice D V Shylendra Kumar had openly expressed his displeasure over the manner in which the Chief Justice of the Karnataka High Court, Dinakaran had been allocating matters.

In this regard, Justice Kumar also summoned the Registrar Judicial and passed some nasty remarks which was reported in the newspapers.

Upset over the events, the Registrar Judicial decided to file a petition in the Supreme Court of India against this.

The RJ represented by senior counsel, Uday Holla, argued that such reporting of matters in the Press had caused immense disregard in the minds of the litigant who came to the court seeking justice.

The Supreme Court observed when the matter came up before it today that such orders are not in conformity with the earlier orders passed by them. Further the Bench also stated that the Chief Justice of Karnataka who has been asked to go on leave and not handle judicial work continues to hold the administrative powers.

Despite not doing judicial work, he continues to be a Chief Justice and this should be placed before the Chief Justice of India for further consideration, the Bench further observed.
