Rizwanur case: HC adjourns verdict on chargesheet

The Calcutta high court on Wednesday adjourned its verdict on a peitition for stay of an earlier order directing the CBI to file a chargesheet against seven persons in connection with the death of computer graphics teacher Rizwanur Rahman.

A division bench comprising Chief Justice S S Nijjar and Justice Maharaj Sinha, declining to pass an interim stay, however, asked the CBI not to press the matter till it passed the verdict on the stay application.

Rizwanur's father in-law and industrialist Ashok Todi, another relative Anil Saraogi and three police officers, besides two other accused, had moved the court seeking a stay on Justice Dipankar Dutta's order directing the Central investigating agency to chargesheet them.

Praying for a stay on the order during pendancy of an appeal against Justice Dutta's directive, they on Wednesday claimed that the trial court's order directing CBI to chargesheet them in connection with the youth's death was unconstitutional and void.

Rizwanur, who was under tremendous pressure to separate from his legally married wife Priyanka Todi, daughter of Ashok Todi allegedly at the instance of the police, was found dead beside rail tracks on September 21, 2007.

The incident sparked a countrywide furore and the high court asked the CBI to probe the cause of his death.
