Daya Nayak will surrender on Monday

The lawyer of suspended encounter specialist Daya Nayak has claimed that his client was not absconding and would surrender on Monday.

"We have given notice to the concerned court this morning stating that Nayak would be surrendering on Monday," Nayak's lawyer Shyam Marwadi told PTI.

Meanwhile, the Anti Corruption Bureau on Saturday obtained a non-bailable arrest warrant against Daya Nayak claiming that Nayak's whereabouts were not known.

According to Marwadi, the 'notice' was given to the court of Judge S P Mahajan, who was on leave on Saturday. The arrest warrant was issued by Additional Session Judge P N Deshmukh, who was probably unaware of the said intimation.

Public prosecutor R V Kini was not available to clarify whether prosecution knew about Nayak's intimation that he would surrender on Monday.

The Supreme Court had on Friday refused to give relief to Nayak and asked him to surrender. The apex court observed that it would not interfere with the order of the Bombay high court, which rejected the anticipatory bail plea of Nayak.

The special court also extended the judicial custody of Nayak's associate P Manivelan up to March 4. Manivelan is accused of helping Nayak launder his 'ill-gotten' wealth.

Earlier, Nayak, his wife Komal and associate Rajendra Padte had moved a sessions court for anticipatory bail but their plea was rejected. They moved the Bombay high court, which rejected the bail plea of Nayak and Padte but gave bail to Komal.
