Govt to move SC against Gauhati HC order on CBI

Government will move the Supreme Court on Saturday seeking a stay on the Gauhati high court order terming the Central Bureau of Investigation as unconstitutional. 

"The Union of India will file a petition in the Supreme Court on Saturday which is likely to be heard on Monday," CBI Director Ranjit Sinha told PTI.

The government is moving with urgency in the matter because it feels that the Gauhati high court order may create uncertainty over the functioning of the premier central probe agency.

Official sources said there is a likelihood of the matter being mentioned before the Chief Justice on Saturday or even on Sunday.

On a day of hectic developments, V Narayanswamy, minister of Department of Personnel and Training, held a series of meetings with Sinha and law officials, official sources said.

Sinha and his team had a meeting with Attorney General Goolam E Vahanvati after which the content of the petition was finalised, the sources said.

Unfazed by the Gauhati high court order, the CBI director said "it is business as usual for us and the order will have no bearing on the cases being handled by CBI."

When told that some of the accused, including those chargesheeted in the 2G telecom spectrum allocation case, had moved courts seeking quashing of proceedings against them citing the Gauhati HC order, Sinha said "it's nothing and our legal team is capable of handling the issue."
