Chief Metropolitan Magistrate Vidya Prakash issued fresh production warrant for Jundal alias Zabi for October 12 after the LeT operative was not produced before him in pursuance of earlier production warrants.
The Mumbai ATS, who were handed over Jundal on July 21, told the CMM that a court in Mumbai has given his custody to it till October 3 and he is further required in other cases being investigated there.
"Abu Jundal alias Zabi Ansari not produced even today. Pursuant to production warrant issued against the accused, ATS Mumbai filed a report wherein it is mentioned that the accused is in police custody of ATS Nashik," the court noted.
"It is further informed that the police custody of said accused would be further required in other case being investigated by ATS Pune," the CMM noted.
"Issue fresh production warrant of accused for October 12," the CMM ordered.
Jundal's custody was handed over to ATS Mumbai on July 21 on its plea that he is required for interrogation in various terror cases in Maharashtra after the Delhi Police said it no longer required his custody.
The 30-year-old Jundal, allegedly associated with the Lashkar-e-Tayiba, is wanted by the Mumbai ATS in connection with four cases -- Aurangabad arms haul case, the 26/11 Mumbai mayhem, the German bakery blast and the Nasik Academy attack.
Jundal had allegedly trained the 10 Pakistani terrorists who had attacked Mumbai on November 26, 2008, besides teaching them basic Hindi and apprising them of Mumbai's topography.
After his deportation from Saudi Arabia, he was arrested from the Indira Gandhi International Airport here on June 21 by the Delhi police.
The Delhi police has in its charge sheet against Jundal accused him of being involved in terror activities across India to avenge "atrocities" against Muslims, particularly those committed during 2002 Gujarat riots.
The police has booked Jundal under section 471 (using as genuine a forged document), 489 B (using as genuine, forged or counterfeit currency), 489 C (possessing counterfeit currency) and 120 B (criminal conspiracy) of Indian Penal Code.
Jundal has also been booked under various provisions of the Explosive Substances Act, and the Unlawful Activities Prevention Act, besides the Passport Act and Arms Act.
