Court denies bail to Rajesh Talwar's attacker

The bail application of Utsav Sharma, who had attacked Aarushi's father Rajesh Talwar in court premises, was on Tuesday rejected by the chief judicial magistrate court in Ghaziabad.

S P Chaudhry, Utsav's lawyer, told PTI that they will now move his bail application before the district and session court in a day or two on the grounds of his mental condition.

Sharma was brought under tight security in Ghaziabad in the court where Chief Judicial Magistrate D D Ojha himself questioned the 30-year-old.

The CJM had on Monday ordered Sharma to be presented before the court before deciding whether he should be admitted to a psychiatric facility or be lodged in jail.

Sharma is presently facing attempt to murder charges (Section 307 of IPC) and also charges under provisions of 7 Criminal Law Amendment Act after he was arrested in connection with the assault on Talwar.

Utsav's mother Indira Sharma had moved an application on January 28 before the court requesting that her son be transferred to the AIIMS or the Shahdara Psychiatric Hospital.

The judge talked to Utsav in presence of his advocate and concluded that he would be examined by a medical board before to reach any conclusion about his mental condition.

The CJM, who did not dispose of the application, directed that Utsav's treatment would continue in jail and a medical board would be setup for further investigation.

Jail Superintendent Viresh Raj Sharma said that a high alert security cover is being provided to Utsav in the jail hospital.

Utsav, a former student of Ahmedabad's National Institute of Design, had attacked Rajesh Talwar with a cleaver outside a special CBI court on January 25.
