The Central Bureau of Investigation informed the Rajasthan high court on Tuesday that midwife Bhanwari Devi is no more and requested the court to quash the habeas corpus petition filed by her husband Amarchand.
But the court refused to quash the petition and asked CBI to produce the final report on February 21.
The CBI had appeared before the division bench of the Rajasthan high court comprising Justice Govind Mathur and Justice N K Jain.
Additional Advocate General Anand Purohit told the court that the corpus is no more so it is not possible to produce her before the court, so there is no relevance of this habeas corpus any more.
The CBI also informed the court that it has almost reached the conclusion of the case and is soon going to file the charge-sheet in court.
The bench asked the agency to file the charge-sheet and produce a report before February 21.
Purohit said that the CBI has invoked Section 302 on the case and is waiting to nab four absconders Indra Bishnoi, Ashok Bishnoi, Pukh Raj Bishnoi and Dinesh Bishnoi.
Wrapping up its probe in the case, the CBI had on Monday claimed it has corroborative evidence to establish that the 36-year-old nurse was murdered and burnt, allegedly at the behest of a political leader.
Highly-placed sources in the agency said the nurse had been strangulated and later burnt. Her ashes, along with belongings, were dumped in the nearby Rajiv Gandhi canal.
