The Supreme Court Bar Association on Tuesday revoked the suspension of senior advocates R K Anand and I U Khan who were shown by a television channel as allegedly influencing a witness in the BMW [Images] hit-and-run case.
The suspension was revoked by the SCBA Executive Committee after considering a report by a three-member subcommittee, which said that 'prima facie' it did 'not find anything corrupt and/or offensive' against Anand and Khan.
The suspension has been revoked after a majority of the members sought such a step, P H Parekh, SCBA president and a member of the sub-committee, said.
Parekh had a dissenting note.
"I was of the view that suspension of I U Khan should be revoked but not in the case of R K Anand, but majority of the members supported the revocation of suspension of both the lawyers," he said.
However, Parekh said that a decision on the show cause notices issued to the two lawyers would be taken after the issue is disposed by the Delhi High Court, which had initiated suo moto proceedings against them.
Holding the decision of the Bar as vindication of his stand, Anand said "I am sure that I would succeed in future also on this issue and I am thankful to the Bar members."
Khan also welcomed the decision saying there was no truth in the story and added that the day was not very far when the real conspirator would be exposed.
On June 4, the Bar Association had suspended the two senior lawyers for allegedly influencing the witness and had issued show-cause notices asking them why action should not be taken against them.
