Put Shahabuddin behind bars: Patna HC

The Patna high court on Monday issued a show cause notice to the District Magistrate and Superintendent of Police of Siwan district for letting Rashtriya Janata Dal Member of Parliament Mohammad Shahabuddin be in hospital while in custody, and ordered him to be put behind bars within two days.

Justice Bal Krishna Jha, who had on July 15 cancelled the provisional bail granted by a Siwan fast track court to Shahabuddin to attend the ongoing monsoon session of Parliament, took the district officials to task for returning Shahabuddin to Siwan Sadar hospital on his return from New Delhi.

The judge ordered the authorities to file a compliance report to the court on July 26.

Shahabuddin's counsel Y V Giri argued that since a copy of the court's order was not made available to the district administration they interpreted the order in that way.

Earlier on July 15, Justice Jha, who had earlier rejected the bail petition of Shahabuddin in connection with kidnapping and murder of a CPI-ML (Liberation) worker Munna Chaudhary in 2001 in Siwan, annuled the fast track court's order and ordered to send the MP behind bars.

The HC, however, granted him bail in three other cases.
