New Madras high court judge to hear Tansi case: Supreme Court

A three-judge Constitutional bench of the Supreme Court directed that a new Madras high court judge should hear the Tansi land case against Tamil Nadu Chief Minister J Jayalalithaa.

The chief justice of the Madras high court would appoint the new judge.

Madras high court Justice Balasubramaniam was hearing the Tansi land case, before the Supreme Court stayed the proceedings last week.

The Supreme Court also directed the registrar of the Madras high court to give all documents of the Tansi case to the petitioner, K V Venkatapathy.

"The hearing shall not commence earlier than October 1 and the case would be heard afresh," decided the bench.

Justices S P Bharucha, Brajesh Kumar and Ashok Bhan were hearing the public interest litigation.

The judges clarified that they had not passed any order against Justice Balasubramaniam, and any earlier comment by the apex court should not be deemed as a reflection on his integrity as a judge.

This decision has come at a time when another Supreme Court bench is hearing the legality of her assumption of office as chief minister.
