The Supreme Court on Wednesday gave two weeks' time to the Centre and the Jammu and Kashmir government to file replies to a petition seeking declaration of Kashmiri migrant families as those belonging to the Below Poverty Line category to avail themselves of the benefits of the centrally sponsored scheme.
A Bench comprising Justice B N Kirpal and Justice K G Balakrishnan, while giving time to the governments to file reply to the petition filed by Jammu and Kashmir National Panthers Party, directed the governments to ensure availability of food and clothing to the needy in the state.
Appearing for the petitioner, party president Bhim Singh said migrants hailing from Jammu and those displaced from the areas near the Line of Control and the International Border due to militancy have been denied their basic human rights and go without food.
The migrant families have not been provided any assistance under the various schemes launched by the central government for the poor though these people have lost their land, houses and crops, Singh contended.
He said the government should provide free ration such as food, medicine, kerosene oil and clothes and educational facilities to children of migrant families as directed by the Supreme Court for BPL families.
