Court rejects petition against Musharraf

K J M Varma in Islamabad

The Lahore high court on Friday rejected a petition challenging the assumption of President's office by Pakistan's military ruler General Pervez Musharraf, saying that existing rules do not allow a law suit against the President.

The petition, filed by the Lawyer's Forum in Lahore, had been returned on Friday by the court registrar on the grounds that it had been filed before the principle seat of the Lahore high court, which was not the proper bench to deal with the matter.

The registrar also declined to entertain the petition on the ground that Article 248 of Pakistan's Constitution disallowed any legal challenge to the President of the country.

Not deterred by the Court's decision, Mian Hanif Tahir of the Lawyer's Forum has now filed another petition asking it to be referred to the chief justice of the Lahore high court.

The latest petition says that General Musharraf, a government employee by virtue of being the chief of the Army staff, could not hold the office of the President parallelly.

It also says that only Parliament could elect the President.

A similar petition is pending before the Sindh high court in Karachi.
