Congress flays BJP on Ayodhya case

The Congress on Friday accused the Bharatiya Janata Party and its government in Uttar Pradesh of "subverting the due process of law".

Congress spokesman Anand Sharma criticised their inability to rectify 'infirmities' in a notification under which the Ayodhya case was transferred to a special judge, because of which it has been held up.

"They have chosen not to rectify the infirmities, which is technical, as underscored by the Lucknow bench of the Allahabad high court. They have done so to shield guilty party leaders," said Sharma.

He pointed out that party president Sonia Gandhi had written to Prime Minister Atal Bihari Vajpayee on Friday, urging him to initiate steps to remove shortcomings in the notification of 1993, so that justice is allowed to take its course.

The Congress chief expressing anguish over the delay by the UP and central governments to remove the infirmities in the earlier notification, which was technical.

She pointed out that her party had been informed that the Central Bureau of Investigation had sent a communication to the Union department of personnel and training. The communication recommended that the central government advise the UP government to rectify the infirmities.

"We have also been told that no action has been taken in this matter, either by the central government or UP government," Sonia emphasised in her letter.

The spokesman said, "We hope the governments will show due respect to the Constitution and process of law" by doing the needful.

He also maintained that by not rectifying the infirmities, "the BJP has sent signals to the international community that when it comes to its leaders, it will resort to the brazen defiance of the law of the land".

Sharma pointed out that senior BJP leaders like Union Home Minister Lal Kishenchand Advani, Dr Murli Manohar Joshi and Uma Bharti had "not yet been absolved" by the court, probing the demolition of the Babri masjid.

When it was pointed out by a reporter that the deadline for rectifying the infirmities in the Ayodhya notification was Friday, Sharma admitted that its passage would result in the "case falling through".

"But we will not shirk responsibility and will actively examine what legal steps can be taken to allow justice to take its natural course," the spokesman pointed out.
