Brig Surinder Singh to move court against discharge

Brigadier Surinder Singh, the controversial officer who was discharged from the army this morning with full pension benefits, is planning to move the high court against his discharge.

"My client has gone to Ranchi, where he will be served the dismissal notice by the army," Singh's advocate, R S Randhawa, told rediff.com. "He will probably take a week to wind up his affairs there and come back. Meanwhile, we are planning to move the high court challenging the dismissal."

Randhawa said that he and his client were yet to decide which high court to move. "There are two that have jurisdiction -- the one in Delhi, given that such orders emanate from the army headquarters, and the other in Jammu and Kashmir, as the incident in question occured there," Randhawa points out.

Brig. Singh has been charged with being lax in the performance of his duties as commander of the Kargil division. The army's position is that this laxity was responsible for allowing thousands of armed Pakistanis to occupy vantage positions on the Indian side of the border -- which in turn led to a two-month, full-scale war before the intruders were chased back.

The Indian army suffered a heavy casualty rate, as the Pakistani intruders had managed to occupy strategy locations high on the hills.

"That is the army's version," Randhawa says. "My client has said even earlier, that he had given early and clear intimation to all senior commanders, including then Chief of Army Staff General Ved Prakash Malik.

"My client has his own story to tell, and he has a right to tell it. So before we go to court, my client would like to meet with the media, we intend to hold a press conference in Chandigarh, sometime early next week."
