Plea against Jaya's appointment dismissed

The Madras high court dismissed on Friday a petition challenging J Jayalalithaa's appointment as chief minister of Tamil Nadu because similar petitions are pending before the Supreme Court.

A division bench comprising Chief Justice N K Jain and Justice P Thangavel dismissed the public interest petition filed by retired police inspector Mohanraj, but gave him the liberty to be heard by the Supreme Court.

Mohanraj's petition pointed out that Jayalalithaa had been disqualified from contesting elections under the Representation of the Peoples Act following her conviction in two corruption cases and sentence of two and three years' rigorous imprisonment.

The petitioner also sought a direction from the court to collect Rs 500 a day from Jayalalithaa as fine from the day she assumed office.

The judges dismissed another petition by Mohanraj challenging K Kalimuthu's election as speaker of the Tamil Nadu assembly.

Mohanraj said Kalimuthu could not hold the post as he was being investigated by the Central Bureau of Investigation in a bank fraud case.
