Azhar case posted for February 26

The second additional chief judge, city civil court, has posted a suit filed by former Indian skipper Mohammed Azharuddin against the Board of Control for Cricket in India for further hearing on February 26.

When the matter came up for hearing on Wednesday, the judge granted time to BCCI president A C Muthiah and BCCI vigilance commissioner K Madhavan, to file counter-affidavits by February 26.

The BCCI defended its action of imposing a life ban on Azharuddin for alleged match-fixing. "We have filed our reply, wherein the BCCI has defended the ban imposed on Azharuddin. I don't want to say anything more since the matter is sub judice," BCCI counsel Radha Rangaswamy told newsmen outside the court hall.

A BCCI official, who had come to the court, left after the matter was heard for a few minutes around noon.

Azharuddin had challenged the life ban and pleaded with the court to direct the BCCI to allow him to play cricket for the national and other teams. The suit was filed on January 29 against the BCCI, its president and vigilance commissioner.

Azharuddin sought a permanent injunction restraining the BCCI, Muthiah and Madhavan from either interfering or restricting his cricket career. He also sought a direction from the court declaring the appointment of Madhavan as vigilance commissioner of BCCI and enquiry report by him to the BCCI as "null and void" as both were contrary to established procedures.

The former cricket captain sought a direction from the court declaring as null and void the life ban imposed on him as it was 'violative' of the principles of natural justice as well as Articles 14, 16, 19, 20 and 21 of the Indian Constitution.

Second Additional Chief Judge J Shyamsundar Rao, City Civil Court, had issued urgent notices to the BCCI, Muthiah and Madhavan on January 30, to file counter-affidavits by February 14.
