SC spoils Jayalalitha's party, stays HC order discharging her

In a major setback to AIADMK chief J Jayalalitha, the Supreme Court on Friday stayed a Madras high court judgment discharging her from the TANSI land deal case.

The interim stay was granted by a division bench comprising Justices K T Thomas and M B Shah during preliminary hearing of a special leave petition by the Tamil Nadu government against the impugned judgement dated January 13.

The court directed the special court in Madras to proceed with the trial of the accused in the case, including Jayalalitha, with the rider that it would not pronounce the judgement till the disposal of the SLP.

"The reasons stated by the high court in the impugned judgment discharging Jayalalitha from the case were prima facie not sufficient warranting interference by the high court with the trial of the accused former chief minister", Justice Thomas observed.

The court issued notice to Jayalalitha and directed listing of the case after three weeks.

The court said the SLP filed by the Tamil Nadu government in the coal import case in which the high court had upheld a Madras special court order discharging Jayalalitha from the case would be taken up for hearing on Monday.
