Centre notifies Constitution review commission

The National Commission to Review the Constitution will explore how best the statute can respond to the changing needs of an efficient, smooth and effective system of governance within the framework of parliamentary democracy.

Spelling out the terms of reference for the commission, a gazette notification issued late last night said the panel would recommend changes, if any, that are needed in the provisions of the Constitution without interfering with its basic structure or features as defined by the Supreme Court.

The commission will have its headquarters in Delhi and have a term of one year.

The NCRC will consist of a whole-time chairperson, who will be assisted by not more than 10 other members selected on the basis of their proven expertise and knowledge in the field of constitutional law, economics, politics, law, sociology, political science and other relevant subjects.

The NCRC has been given a free hand to decide its procedure while hearing and entertaining all persons, representations and communications, which, in its opinion, will facilitate its work and final recommendations.

The chairperson will receive a consolidated honorarium of Rs 30,000 per mensem. His or her pension will be deductible from the honorarium in case the chairperson is a pensioner.

The chairperson will also be provided suitable official accommodation as per entitlement.

The secretary to the commission will be paid a monthly honorarium of Rs 25,000. The members of the commission will be paid a daily allowance of Rs 1,000 while on duty.

The NCRC's funding will be through a separate budgetary allocation by the government under the relevant budget provisions of the Ministry of Law, Justice and Company Affairs.

Research and other staff for the commission will be provided by the Department of Legal Affairs. Supervisory control over the staff will vest in the secretary to the NCRC who will discharge his functions under the overall control of the chairperson.
