Judge cancels warrant against Win Chadha

Ajit Bharihoke, the special judge hearing the Bofors case, cancelled the non-bailable warrants against Dubai-based Indian businessman Win Chadha and directed him to appear before the court on March 21, 2000 at any cost.

The judge had earlier issued non-bailable warrants against Chadha after he failed to appear before the court on February 3 as his counsel had promised. Chadha and several others are facing charges of having receiving kickbacks in the deal.

Chadha's advocate Ritu Singh Mann spoke to her client before giving an undertaking to the court that he would definitely appear in court at the next hearing.

My client had some technical difficulties, due to which he didn't appear on the last date, she told the court. When asked what the difficulties were Mann said that the government had not handed a passport to a client despite the fact that it was ready to be delivered. Without the passport, the necessary Visa endorsements to travel from the UAE could not be done, she said.

Counsel for the Central Bureau of Investigation P P Sinha told the court that her client could fill and give some forms to the government that would do the needful. Mann accepted this suggestion on behalf of Win Chadha.

Chadha, M/s Bofors, its former president Martin Ardbo, former defence secretary S K Bhatnagar and Ottavio Quattrochi , relative of the former prime minister of India Rajiv Gandhi are facing charges of corruption. Though Rajiv Gandhi too was named as an accused earlier, his name has not been sent for trail since he is no longer alive.

The government of India cancelled Chadha and his son Harsh Chadha's travel documents were cancelled when the two fled the country.
