Govt revives CVC sans statutory powers

The Union government today decided to issue a resolution to provide for continuance of the Central Vigilance Commission until the bill for the purpose is passed and becomes an act of Parliament .

Briefing newspersons about the cabinet decision, Information and Broadcasting Minister Pramod Mahajan said an ordinance to confer statutory powers on the Central Vigilance Commission was issued on August 25,1998 following a direction from the Supreme Court. Thereafter, an amendment was made and another ordinance issued. In order to replace these two ordinances, a bill was brought forward in the Lok Sabha where it was passed.

Mahajan said the bill was listed for discussion in the Rajya Sabha on two days, but on both the days the upper house could not conduct business.

Since the ordinance was due to lapse on April 5, the government, on the advice of the additional solicitor general and attorney general, decided to issue a resolution to let the CVC continue to function, he said.

Mahajan said the vigilance commission will continue to function on the same lines and on same terms and conditions and under the same provisions as provided for in the ordinance, but will have no statutory powers for a month or so until such time the bill for the purpose is passed by Parliament.

Before the ordinance lapses on April 5, the executive order for continuance of the vigilance commission will come into force, Mahajan said.
