Centre seeks review of SC verdict in JMM bribery case
The central government today filed a petition in the Supreme Court seeking a review of its judgment in the Jharkhand Mukti Morcha bribery case which held that the members of Parliament who were bribed to vote for the P V Narasimha Rao government in 1993 were protected under Article 105(2) of the Constitution, though not those who paid the bribes.
The judgment was delivered on April 17 by a five-judge constitution bench. Two members of the bench have since retired.
The review petition was brought to the notice of a three-judge bench comprising Justice M K Mukherjee, Justice G B Pattnaik, and Justice S P Kurdukar during the resumed hearing of appeals by many of the accused, including former prime minister Narasimha Rao.
The appeals were directed against a verdict of the Delhi high court upholding the orders of a special judge of Delhi for framing charges against them.
Meanwhile, Justice Mukherjee has excused himself from the bench, stating that he could not take up the burden of hearing the matter at this stage. Justice Mukherjee retires on December 1.
Now another bench will hear the appeals after disposal of the review petition.
