Maharashtra announces judicial probe into Enron deal

The Maharashtra government on Wednesday announced a judicial probe into various aspects of the power purchase agreement signed between US energy major Enron's Dabhol Power Company and Maharashtra State Electricity Board.

The terms of reference of the probe would be decided by the co-ordination committee of the ruling Democratic Front within a month, Chief Minister Vilasrao Deshmukh said.

Deshmukh told reporters that the government had sought legal opinion from the state Advocate General Ghulam Vahanvati and that the probe would be as per the Commission of Inquiries Act.

The DF co-ordination committee would prepare the terms of references, ratify them and then the proposal would come before the state cabinet for approval, he said.

"Once the Cabinet okays it, further action would be initiated," the chief minister said.

Deshmukh said the decision on the judicial probe would have no bearing on the on-going renegotiations process being looked into by a committee headed by former Union Home Secretary Madhav Godbole.

After persistent queries by the media, he said the inquiry would be time bound but the details would be decided later.

"The DF committee would look into all aspects of the entire Enron agreement and also take care that various court cases in connection with it are not hampered," Deshmukh said.

Deshmukh, however, confessed that at this point of time he himself was not aware whether the probe would be initiated against only the power purchase agreement or any individual.

"We have to be very careful while drafting the terms and conditions of the probe as the stakes are very high", he said.

Those present at the meeting were Deputy Chief Minister Chaggan Bhujbal, DF co-ordination committee convennor N D Patil, Republican Party of India leader R S Gavai, state Janata Dal chief Nihal Ahmed, state Energy Minister Padmasinh Patil and Nationalist Congress Party state chief Babanrao Pachpute.
