SC gives Jaya 2 weeks to reply in Spic case

The Supreme Court on Monday gave two weeks to Tamil Nadu Chief Minister J Jayalalithaa, the Tamil Nadu government and the Tamil Nadu Industrial Development Corporation to file counter replies in the controversial Southern Petrochemicals Industries Corporation divestment case involving a loss of Rs 280 million to the state government.

Justice K T Thomas and Justice R P Sethi granted two weeks to the parties after their counsel requested for time to file their replies. The bench was hearing an appeal filed by the Central Bureau of Investigation against a Madras high court order staying the trial of Jayalalithaa and other accused in the case.

The case relates to a loss of about Rs 280 million to the Tamil Nadu government because of the Tidco's decision to renounce its shares in favour of Spic.

The Madras high court directed Jayalalithaa, former chairman of Spic M A M Ramaswamy -- since deceased -- and his son A C Muthiah to repay the amount of Rs 280 million to the state government.

The high court also directed the CBI to register a case for recovery of the amount and prosecution of the accused persons.

When the CBI filed the chargesheet in the case before the special court, Jayalalithaa filed a writ petition before the high court, challenging the same.

The single judge of the high court upheld the filing of the chargesheet, but on a writ appeal, filed by Jayalalithaa, a division bench of the high court stayed the trial. Hence, the appeal by the CBI with the apex court.

Earlier, the apex court had directed the special court to proceed with the trial, asking the accused persons to file their counters.
